Somatine Privacy Policy
This Privacy Policy (the "Policy") explains how Somatine (the "Company") collects and uses your information in connection with your access to and use of somatine.com (the "Website" or "Site"). As used in this Policy, "you," "your," and similar terms mean any visitor to or user of the Site, and "we," "us," and "our" mean Somatine.
Thank you for visiting somatine.com. In addition to this Policy, your use of the Site is governed by our Terms of Service ("Terms"). This Policy is incorporated into the Terms and does not amend, replace, or modify the Terms or any other policies that apply to the Site.
By using the Site and providing your personal information to us, you consent to the collection of certain personal and non-personal information, and you agree that it may be collected, used, stored, processed, and transmitted as described here. If you do not agree, you must stop using the Site immediately and should not share any personal information with us.
Information Collected
We collect personal and non-personal information as you communicate with us (through the Site and other channels, such as Facebook), as you interact with the Site, and as you purchase products. The personal information we may collect includes what you provide when you register for an account, such as your name, account password, mailing address, phone number, and email address.
We use third-party payment processors to handle payments. When you enter your payment details on the Site, that information is collected and processed by those processors.
If you interact with us through social media (including Facebook), we may collect publicly available personal information (for example, your public posts, photos, likes, favorites, friends, or followers) or information made available to us through that interaction (for example, your direct or private messages to us). Disclosure of Information
We will not share or disclose your personal or non-personal information with any third party except in the following circumstances:
We may share it with our third-party vendors and data processors (including Shopify, Inc.) in connection with fulfilling and shipping your orders, processing payments, and otherwise providing the products you order. We do not authorize these vendors to use your personal information for any other purpose.
We may share your personal information with our affiliates and with other businesses whose products or services we think may interest you, and they may use it to the same extent we're permitted to. You can ask us not to share your information for this purpose by emailing support@somatine.com. If it is shared this way, those third parties' privacy policies will govern their use and further disclosure, and we have no control over or responsibility for that.
We may disclose your information if we determine, at our sole discretion, that doing so is reasonably necessary to investigate, detect, prevent, or mitigate any suspected or actual fraud, property damage, bodily injury, illegal activity, or violations of the Terms.
We may disclose your information to protect or enforce our legal rights and policies, to protect or enforce a third party's legal rights, or where we determine disclosure is required by law or regulation (such as a subpoena or court order).
We may disclose non-personal information, in aggregate form not associated with your personal information, to our affiliates, potential business partners, advertisers, and investors, and for other business and marketing purposes.
Your personal and non-personal information may be disclosed to any entity that acquires our business or assets (in whole or in part, including through a merger, reorganization, or bankruptcy), and that entity may use and disclose it to the same extent we are permitted to under this Policy.
Storage, Transmission, and Protection of Information
We collect, store, transmit, and protect your personal information using vendors that provide industry-standard encryption and security protocols that we believe reasonably protect it. We choose vendors we believe adequately protect your information, but we do not have actual control over them and cannot be liable for their actions, errors, or omissions.
Our vendors may have terms and privacy policies that differ from this one, and we have no control over or responsibility for how they collect, store, transmit, or use your information. Your information may be collected from, transmitted to or from, and stored in multiple locations worldwide. We may store, transmit, and use your personal and non-personal information indefinitely.
Transmitting and storing personal information over the internet carries a risk of inadvertent disclosure or unauthorized access by third parties, such as hackers and other cybercriminals who exploit security flaws or introduce viruses, worms, or Trojans. We will take commercially reasonable measures to reduce that risk but cannot eliminate it entirely. By providing your personal information, you accept the risk that it may be disclosed to or accessed by third parties inadvertently or without authorization. We are not responsible for the actions of third parties who access or attempt to access your information without our authorization, or for the consequences that result.
Privacy of Minors
Children under 13 are prohibited from using the Site. We do not intentionally or knowingly collect or solicit personal information from children under 13. If you are under 13, please do not use the Site. If we learn we have inadvertently collected personal information from a child under 13, we will promptly delete it.
Legal Compliance
Nothing in this Policy is intended to conflict with any rights, duties, or obligations established by laws or regulations that apply to you or your information, including those regarding data protection, privacy, and data breach notification. If any provision of this Policy conflicts with or is unenforceable under any applicable law or regulation, that law or regulation will prevail and we will comply with it.
State or federal law may require us to notify you (in certain circumstances) if your personal information has been compromised, and we will comply with our legal obligations in applicable jurisdictions. The laws that apply to us and to our handling of your information may differ from those where you live.
Notice to California Residents
The California Consumer Privacy Act of 2018 (CCPA) gives California residents additional rights regarding access to and deletion of their personal information. The rights in this section apply only if you are a consumer and a California resident, and are in addition to the other rights described in this Policy.
You may request that we disclose certain information about our collection and use of your personal information over the past 12 months. After we receive and confirm your verifiable consumer request, we will disclose: (i) the categories of personal information we collected about you and the sources; (ii) our business or commercial purpose for collecting or selling it; (iii) the categories of third parties with whom we shared it; and (iv) the specific pieces of personal information we collected. If we sold or disclosed it for a business purpose, we'll provide the relevant categories. We will disclose the categories (but not the identities) of third parties unless otherwise required by law.
You may request that we delete some or all of the personal information we collected from or about you. After we receive and confirm your verifiable request, we will delete it (and ask our service providers to do the same) unless an exception applies. We may deny a deletion request where retaining the information is reasonably necessary to: (i) complete your transaction or provide a product or service you requested; (ii) take actions reasonably anticipated within our ongoing business relationship; (iii) fulfill a written warranty or product recall under federal law; (iv) detect security incidents or protect against malicious, deceptive, fraudulent, or illegal activity; (v) maintain the Site or repair errors; (vi) exercise free speech or ensure another's right to do so; (vii) engage in internal uses reasonably aligned with your expectations based on our relationship; (viii) comply with a legal obligation (including the California Electronic Communications Privacy Act, Cal. Penal Code §1546 et seq.); or (ix) otherwise lawfully use it consistent with the context in which we obtained it.
You may also request, under California Civil Code §1798.83, information about our disclosure of your personal information to third parties for their direct marketing purposes.
To make any request described above, email support@somatine.com. Only you (or someone legally authorized to act for you, with documentation we find reasonably sufficient) may make a request about your personal information. You may also make a verifiable request on behalf of your minor child. Unless otherwise permitted by law, you may make such a request no more than twice in any 12-month period.
Every request must include enough information for us to reasonably verify that you are the person we collected personal information about, or an authorized representative, and enough detail for us to understand and respond. We may contact you by phone or email for additional verification information. We cannot respond if we can't verify your identity or authority. Any personal information you provide for verification will be used only for that purpose.
We will respond to a verifiable request within 45 days. If we need more time (up to 90 days total), we'll tell you why and how long in writing. We'll communicate and provide any response by phone or email unless you ask us to use mail. Responses reflect only the 12-month period before we received the request and may explain any reasons we can't fully comply. Any personal information provided will be in a format that's readily usable and portable. There's no fee unless the request is excessive, repetitive, or manifestly unfounded, in which case we'll explain the basis and give you a cost estimate first.
If you are 16 or older, you have the right to direct us not to sell your personal information at any time. To exercise this opt-out, you (or your verified authorized representative) may email support@somatine.com. After 12 months, we may ask you to reauthorize sharing. We'll use information provided with an opt-out request only to process that request.
We do not sell the personal information of California residents we believe, to the best of our knowledge, are under 16 unless we receive affirmative consent from: (i) the consumer, if they are at least 13 but under 16; or (ii) the parent or guardian, if the consumer is under 13. Consumers between 13 and 16 who opt in may opt out later at any time by contacting support@somatine.com.
We will not discriminate against you for exercising your CCPA rights. Unless permitted by law, we will not: (i) deny you products or services; (ii) charge different prices or rates, impose penalties, or deny discounts generally available to others; (iii) provide a different level or quality of products or services; or (iv) suggest you'll receive a different price, level, or quality for exercising your rights. We may, however, offer certain benefits or incentives (where permitted) that result in different prices or qualities if you agree to the sharing or disclosure of your personal information. Any such incentive will reasonably relate to the value of your information, and we'll describe the material terms in writing. You may opt out of any such program at any time by contacting support@somatine.com.
Changes and Updates to This Privacy Policy
We may, at our sole discretion, change, modify, add to, or remove this Policy, in whole or in part, at any time and without prior notice. While we'll make reasonable efforts to notify you of changes, such notice isn't required for changes to take effect and be binding. The current version is always posted on the Site, and it's your responsibility to review it periodically. Your continued use of the Site after any change means you accept it.
